I make appliqued kids shirts and I'm thinking about doing a few onesies....anyone know of any that have been tested and that have test results? I use American Apparel shirts and I'm checking with them....

Yes, words like BandAid and Kleenex and Xerox and even Aspirin are all trademarked brand names, but most of those companies either don't seem to mind that their names have become common vernacular or don't feel it'd be worth the fight to keep their names exclusively for their own use. If other makers of similar items go on the market, tho, they can't use those names (except for Aspirin, as far as I know). That's why generic BandAids are "adhesive bandages," and generic tissues aren't "Kleenex," they're "tissues."
And what Generations says is exactly why companies must guard their trademarked names. If they don't they become a generic name from common usage.
ONe thing that has changed from before is that interfacing and bonding fabrics that are used inside garments and under appliques are exempt. Interfacing is an exempt fiber, and the bonding fabrics are considered not touchable since they are enclosed.
Appliques that are purchased form the craft/sewing stores may or maynot be exempt. If they are made from thread, with the iron backing they should be exempt. But, if they contain they gliter, plasticy fabric, (I have some of these that are stars) then those may not be exempt, and require testing or write the company who made them with the sku number.
While Kidsblanks is a good business I did contact them regarding their certs and I did not get a great reply. I wanted to get stuff printed there and sort of got the run around when asking about their paint they used to screen. They did not have the certs in their possession. They said yes our products are lead free but did not have the certs. this was 6 months ago so it may have changed. I ended up doing the screening myself so I could control the product.
So I have actual Gerber Onesies in my shop that I have appliqued and embroidered. I call them Onesies in my listing because I also show that they are the real item in my photos. Is this going to get me into trouble too? I thought since they were the real thing it was okay.

the term ONESIES is a trademarked term by Gerber Childernswear LLC. Use of the term ONESIES is restricted to those sellers who are advertising and selling products that use genuine Gerber Garments (ONESIES).
Gerber doesn't play around. They do issue Cease & Desist letters (electronically) with 24hr time frame to remove the use of the word onesie if used to describe a one-piece that isn't the brand (did happen to me with 2 shops and within a weeks time, but not the etsy shop). I never knew that Onesie was trademarked. I just thought a onesie was a onesie.
