Can a business register as Small Batch Manuf. if only previous years inventory was sold?

Hi, I was wondering if a business that did not manufacture products last year (only sold previous years inventory) is able to register for 2012 as Small Batch Manufacturer?

Also, I have some inventory left from 2009, before the Aug.14 date of the tracking labels' law. Does anyone know if I am required to place tracking labels on those items too? I thought I had read somewhere that only products manufactured after this date need to comply, but I can't find that page.

I believe you are correct. The law wasn't retroactive. I haven't back labeled anything of mine.
