CPSIA amendment failed. What does this mean?

Just saw on the Twitter stream of Senator Jim DeMint ( http://twitter.com/JimDeMint ) that a CPSIA reform amendment has just failed Senate passage. Anyone have more details on this and what the ramifications may be? Thanks!

I'm actually still optimistic that some kind of amendment will pass, or that there will be a test case that shows how unenforceable this actually is in reality.

Do you all feel like I do sometimes? I wonder why I spend all this time writing letters and spreading the word when the amendment ended up failing anyway. Would my time have been better spent designing/creating something (for ages 13+)?

Still trying to figure out what this means? Does it mean that everything that was on the exempt list is no longer exempt? So the volunteers in my charity are now criminals? Good Grief, this is just nuts!

No, it means that there will not be money set aside for people who suffer hardships because of the new law.

I've purchased several items over the last few years that had to be thrown out because it wasn't safe for my child. All the items were from big manufacturors. They should make them test and allow the little guy (us) to use a disclaimer saying it hasn't been safety tested. Otherwise there will no longer be any OOAK items for children. People like having the option to not be a conformist and own unique items, people can read disclaimers and decide for themselves. I do think that the one year postponement says alot, there is way too much stink over this to be ignored so I think they will have to ammend it in the end.

Maybe I haven't had enough coffee yet, or didn't when I read the original amendment, but I thought the main point of the DeMint amendment was to amend the CPSIA, not establish a fund? In other words, to fix the wording of the law itself, not just pay for us to jump thru the hoops anyway?
