Washington, D.C. – The U.S. Consumer Product Safety Commission voted unanimously
(2-0) to issue a one year stay of enforcement for certain testing and certification requirements for manufacturers and importers of regulated products, including products intended for children 12 years old and younger. These requirements are part of the Consumer Product Safety Improvement Act (CPSIA), which added certification and testing requirements for all products subject to CPSC standards or bans.

Significant to makers of children’s products, the vote by the Commission provides limited relief from the testing and certification requirements which go into effect on February 10, 2009 for new total lead content limits (600 ppm), phthalates limits for certain products (1000 ppm), and mandatory toy standards, among other things. Manufacturers and importers – large and small – of children’s products will not need to test or certify to these new requirements, but will need to meet the lead and phthalates limits, mandatory toy standards and other requirements.
The decision by the Commission gives the staff more time to finalize four proposed rules which could relieve certain materials and products from lead testing and to issue more guidance on when testing is required and how it is to be conducted.
The stay will remain in effect until February 10, 2010, at which time a Commission vote will be taken to terminate the stay.

The announcement of the CPSIA stay was exciting, tangible proof that we really are being heard and making great progress. The stay is a partial and temporary relief, but there is much work to be done yet. Political leanings aside, we need bipartisan support in order to fix the CPSIA, and be left with a law that will allow us all to stay in business.

Senator DeMint is introducing a bill this coming Tuesday, to amend the CPSIA. The bill will be presented as an amendment to the stimulus package-- a brilliant idea, which will put the debate into the National spotlight on the Senate floor.

I'm not trying to burst anyone's bubble. I did the "happy dance" to on Friday. But a bit ago I read this information on the Fashion Incubator, and apparently the STAY is anything BUT a done deal.

From the Fashion Incubator:
1) Apparently we should not celebrate the STAY to quickly.

As it stands, the Law goes into force on 02/10. Period.

This proposed FINAL RULE is just a notice that conversations happened and what those conversations entailed).

The rule is being voted on, now. It will take about one business week (02/06) to become official.

Then there is a 30-day comment period for the public to raise concerns about the proposed final rule. Those comments can influence and shape the Final Rule, which is what will be enforced after March 8, 2009.

2) In the meantime the law will go into affect on Feb. 10, 2009 as stated (unless something new happens between now and then.) Meaning that retailers and sellers must follow the Feb. 10 guidelines for lead.

3) the Consumer Groups began organizing quickly, upon the CPSC's announcement on Friday. It is anticipated that they will file law suits early Monday morning to try to get the ruling rescinded. So on Monday morning it's back to activism.

my brother-in-law is an environmental lawyer and one of the other lawyers in his group has been focusing on this law. he sent me the same info matt posted. (i came here to post it but it was already here). here is what he said with regards to when this goes into effect:
"My read of the press release is that the stay is immediate and that the first certificates won't be required until Feb 10 of next year. "

but the vote is in and the stay is official by all accounts. we won the first battle - now let's win the war.

From the sounds of the CPSC notice it looks like crafters, artisans, and homemade producers were heard and made a big impact! Great Job to everyone who did they're part to turn this law around (or at least stop it for now...I guess there is still work for us for the rest of the year)

I guess It's semi-good news. You don't have to test your product for lead and pthalates...and yet your product must still be within certain guidelines...which poses the question, how do you know you're within the allowable lead and pthalate guidlines without testing....hmmmmm. Apparently it is a relief for another year while they figure it out, whoever they are. I don't understand all those big words and all the legal speak (I think they do that on purpose), when it comes to the law there is no room for interpretation. But you don't know what it translates to until you get in trouble...then it's too late to say "but I thought it meant....whatever". I gather as long as you make stuff for children and label it not intended for children under 12, that might be your legal out. Any thoughts...?

I've read the letters from Nancy Nord and Commissioner Morris several times. I've read threads, good and doubtful. I've read opinions, thoughts, my own negative thread. This law is vague. Intentionally. Allows for wiggle room for the CPSC. But for us, it is so difficult. The CPSC is letting us figure most of it out on our own. Nothing clear-cut, no set of rules to follow. Very disappointing!!!

I guess I am confused on the labels. Were they always supposed to be sewn on cloth items? Or, was that part of the CPSIA law from November? If that is the case, is that in the stay? I don't know if it just me being discouraged, or is it just doggone confusing?
