Washington, D.C. – The U.S. Consumer Product Safety Commission voted unanimously
(2-0) to issue a one year stay of enforcement for certain testing and certification requirements for manufacturers and importers of regulated products, including products intended for children 12 years old and younger. These requirements are part of the Consumer Product Safety Improvement Act (CPSIA), which added certification and testing requirements for all products subject to CPSC standards or bans.

Significant to makers of children’s products, the vote by the Commission provides limited relief from the testing and certification requirements which go into effect on February 10, 2009 for new total lead content limits (600 ppm), phthalates limits for certain products (1000 ppm), and mandatory toy standards, among other things. Manufacturers and importers – large and small – of children’s products will not need to test or certify to these new requirements, but will need to meet the lead and phthalates limits, mandatory toy standards and other requirements.
The decision by the Commission gives the staff more time to finalize four proposed rules which could relieve certain materials and products from lead testing and to issue more guidance on when testing is required and how it is to be conducted.
The stay will remain in effect until February 10, 2010, at which time a Commission vote will be taken to terminate the stay.

I can't assume everything is lead free just because I get them from Joann, can I? For instance, button manufacture that sells to Joann said they haven't tested their stuff for lead so they don't issue any certificate.

I think many people here are confident in their suppliers and are confident that the materials they're using don't contain the banned substances, anyway. I was under the impression that's why many of us were so outraged by the law: it would require testing of products we *knew* to be safe, because lead-free raw materials + lead-free manufacturing in our dining rooms does not equal a finished product full of lead. I think the stay is a wonderful thing and a huge help. I feel confident that the final law, whenever it goes into effect, will OK component testing and even exempt some materials (yarn, fabric, other inherently safe materials) completely. The letters I've read from the CPSC have boosted my confidence level that common sense will prevail.

This is great news to anyone that is a manufacturer of childrens items. But, lets face it folks this is long from being over here The CPSIC will be looking for ways to make this law come full circle. We must all keep the pressure on the congress,senate and on the president.
Together with teamwork we can have a law that protects us all and our precious customers. Thank You Matt..

I'm just so thankful for all of you who do make children's things! We must stay on top of this though, cuz one year can fly by and we don't want to let up on pressuring them to make changes in this law.

I have no idea why YadaYadaYAda posted this message to me, I never mentioned anything about labeling one way or the other, maybe she meant someone else?

... incidentally my family's business (which is not on ETSY) is run professionally, it's got lawyers and everything :) like most people on and off ETSY we do what we are supposed to do ....

Anyhow I just wanted to express my glee that children's toy makers and other small businesses are getting guidelines and some more time to deal with this law... that's all.

I"m so happy for you guys!!! (im in Canada) but i was SOOOO bothered by all this.

I'm glad that many people are confident that the materials they use are within the new lead and (in the case of toys for age 12 and under with small parts and child care articles for age 3 and under) phthalate limits. Remember that child care articles are defined as all "consumer products designed or intended by the manufacturer to facilitate sleep or the feeding of children age 3 and younger or to help such children with sucking or teething". The XRF gun does not test for phthalate levels so if you make these kinds of items, be sure to ask your suppliers for certification that their materials meet the new phthalate requirements.
