Washington, D.C. – The U.S. Consumer Product Safety Commission voted unanimously
(2-0) to issue a one year stay of enforcement for certain testing and certification requirements for manufacturers and importers of regulated products, including products intended for children 12 years old and younger. These requirements are part of the Consumer Product Safety Improvement Act (CPSIA), which added certification and testing requirements for all products subject to CPSC standards or bans.

Significant to makers of children’s products, the vote by the Commission provides limited relief from the testing and certification requirements which go into effect on February 10, 2009 for new total lead content limits (600 ppm), phthalates limits for certain products (1000 ppm), and mandatory toy standards, among other things. Manufacturers and importers – large and small – of children’s products will not need to test or certify to these new requirements, but will need to meet the lead and phthalates limits, mandatory toy standards and other requirements.
The decision by the Commission gives the staff more time to finalize four proposed rules which could relieve certain materials and products from lead testing and to issue more guidance on when testing is required and how it is to be conducted.
The stay will remain in effect until February 10, 2010, at which time a Commission vote will be taken to terminate the stay.

The stay of enforcement provides some temporary, limited relief to the crafters, children’s garment manufacturers and toy makers who had been subject to the testing and certification required under the CPSIA. These businesses will not need to issue certificates based on testing of their products until additional decisions are issued by the Commission. However, all businesses, including, but not limited to, handmade toy and apparel makers, crafters and home-based small businesses, must still be sure that their products conform to all safety standards and similar requirements, including the lead and phthalates provisions of the CPSIA.

Absolutely wonderful news, for now!

Many thanks to Matt, Etsy Admin and everyone who has devoted incredible amounts of time and energy trying to get this law changed. A welcome relief for us and the quality of children's lives everywhere. (No homesewing mommies going to jail...hurrah)

More work to do in the next year though......not finished

I read everything, and I think it's a pretty fair compromise. I'm so relieved!!

For people who make things that don't even have a risk for lead or phthalates this is great! For people who may use things like buttons, zippers of vinyls, they still need to comply, even though they will not be prosecuted in any way during the 1 year period. It will require crafters and all mfrs who use components that are at risk for lead and phthalates to go to their suppliers and demand components that meet the requirements. Which I know I will do!

yeah, and the yarn companies have sent letters to cpsc and stated that they do not use lead and proven tests so we can use that letter as "reference" b/c it was to the cpsc but it was from the yarn companies stating "NO LEAD"

Good job, everyone! As the other comments have said, there's still work to be done - but this really illustrates the power of grassroots organizing, and especially the power of the Internet. Yay, team!

Now I can tell that prospective customer (friend of mine) who asked about baby blankets for shower gifts, that I can make some for her after all!

I am sooooo happy.......

I can now start making new things.......

We have a whole year to convince those knuckleheads to either get rid of the law or make some major changes so that the law actually makes sense and can be applied with relative ease.....

Wait, Wait, Wait! As I read through the authority parameters,of The CPSC, I don't think they have the authority to "Grant a Stay" of Public Law 110-314. Their authority is to insure that this law is being followed to the letter. Any stay, or change in the law, would have to come from Congress, and I really don't see that happening any time before Feb 10, 2009. I could be wrong, but I get a sense of smoke-n-mirrors happening. Maybe I'm being paranoid, or maybe we're being lulled into a false sense of security. I'll believe our little businesses are safe when this stupid law is thrown in the trash.

HIP HIP HOORAY for The STAY! That gives us One Year to get suppliers who will have their products Tested and compliant and give Us one year to Get this Law Amended. Otherwise Feb. 10, 2010 we will be in the same boat.

1. Trying to find someone who will test our products without destroying one to find the lead content as the law requires.
2. Trying to find someone who will test cheaper that the amount we were faced with this time, ie $500 to $4000 per color and fabric chosen.
3. Changing the stereotype that handcrafters only care about the $$ and not the child's safety.
4. We will still be OVER TESTING everything made for kids under 12.

We MUST keep fighting to get this Law either amended or Eliminated.

doing the happy dance. now we have a whole year to fight fight FIGHT! and hopefully have them amend the law so small businesses can comply. now i can list new things! i feel a spike of creativity coming on
