Baby clothes, CPSIA & liability’s ! Help ?

Hi there !
I plan on opening my shop in the new year making baby clothes ! (Rompers for now but planning to expand) I’ve done extensive research and know that I have to register as a SBM & have the right tags. My husband just feels that’s “too easy” and that’s there laibility in making baby clothes. Any chance to sue and they will. So, is he right ? Or does Etsy have some kind of deal with that ? Or do we just register as SMB, have the right tags and we’re go to go selling baby clothes ?
Any help would be great !

You do have to do more than just register and put on tags. If you are making clothing for children you need to have 2 forms of labeling. FTC (federal trade commission) labels that have information about the fabrics used. and CPSIA tracking labels that tell who your comapny name is, where you are located and when you made the product. The FTC labeling is very specific and you should use standard labels that are sold on Etsy The CPSIA tracking labels can be ordered on Etsy or you can make you own using printable fabric with all the information For the tracking labels there is no required format, as long as you show all the required information. My labels say,

If you Look on the pinned threads at the top of the discussions you will find links to the FTC laws. I suggest you look and print off both of these and use a highlighter to find all the things that apply to what you want to make. All clothing requires them, and almost all goods that are made of any kind of fiber, fur. leather, just about everything one can ,ale amd sell fall under one or both of these FTC topics. You must comply with them.
AS for the CPSIA regs. you must comply with them also. Now if you register as a SBM you may be exempt from many of the required testing. BUT, everything you sell must actually comply. You have to know that your supplies if tested would pass. You can not sell anything that could be dangerous, so you do have to know the law and understand it. You also have to write a COC a certificate of compliance for each type of article you sell that covers all statutes of the law, and why you comply, some you are exempt from testing because you are registered, you need to show you # as the reason, some you meet the regulations like flammability because your fabric meets the guidelines by weight per sq in and surface texture and fiber content, but you need to list them in a required format and sign it to certify your compliance. These COC are for your records, not for your customers, and are not sent to the CPC, unless you have a complaint and they ask for one. Can you be sued? Anyone can be sued for anything. Etsy has no interest or deal in how we operate our business except to say you must comply with every law that covers your product. There are some things that cover babies that are under a certain age because of chocking hazards. So you have to be aware of the age guidelines and how that affects your products.
