Your hats are very cute. It is my understanding that anything that is intended for, marketed to, or appeals to children 12 and under will need to be labeled beginning in August and starting in Feb. 2010 will need to be tested. Hopefully this law will get amended but for now that is what it states.

From the cpsia guidelines. I'd market them in adult sizes only. If someone gives you a size (unless it's really small) how are you to know who is the ultimate user.

What is a children's product?


A children’s product is one designed or intended primarily for children 12 years of age or younger. Toys, clothes, furniture, books, jewelry, blankets, games, CDs/DVDs, strollers, and footwear may all be considered children’s products.



In determining whether a consumer product is “intended primarily” for a child 12 years of age or younger, the following factors will be considered:



A statement by the manufacturer about the intended use of the product, including a label on the product, if such statement is reasonable.


Whether the product is represented in its packaging, display, promotion or advertising as appropriate for use by children 12 years of age or younger.


Whether the product is commonly recognized by consumers as being intended for use by a child 12 years of age or younger.


The Age Determination Guidelines (pdf) issued by Commission staff.

If a product is intended for adults or for general use by consumers of all ages, then it is not intended primarily for children. Products marketed and priced in a manner that would not make them appropriate for use by a child would also not be intended primarily for children. An example would be an expensive telescope -- because it is sold for general use by all ages, it is not a children’s product even though it can be used by a child on occasion.

Your hats are adorable. The way you are marketing them and the pictures in your listings makes them children's items and subject to cpsia labeling requirements.

You can either:(1) change your listing using different pics showing the hats on adults and remove any mention of children in the listing, or (2) label them

BTW: there are labeling requirements other than CPSIA for garments and textiles. You need to search on labeling requirements for textiles and wool as there are some specific requirements for all garments and especially wool garments.

FayeMaloneDesigns Thanks! So I'm ok if I have them for adults only, but I need to see about how I should label them? I will also have sizes as measurements..so some of the hats could be for older kids. I myself have a very small head and embarrassingly I do; I had to have my caps specially ordered. So if i have unusually sized head measurements and I get some slack...someone from the CPSIA can come measure my head! Hehe

And I will be listing more hats soon, as these are more of a seasonal product, although I know it's not summer in some place:)
