Re: Are clothes allowed?

Are you serious, you know damn well every retailer in America is not going to test the clothing for everyone under 12...are they all to be naked from Feb 10th until they turn 12 yrs of age.

Re: Are clothes allowed?

Everything imported into this country should have been tested before it got here...and what about customs, what are they getting paid for?

Re: Are clothes allowed?

There's no lead in cotton and thread and plastic buttons...you don't have to pay for a test to know that.

I understood when I thought it was just about toys...I am completely dumbfounded to hear it's clothes too. Everybody has to wear clothes.

Re: Are clothes allowed?

We know that, and the CPSC also does due to a letter from the National Textile Association dated almost a year ago. They don't care though and are still requiring testing on any item intended for a child 12 or younger.

Re: Are clothes allowed?

So based on that...any fabric or other notions purchased after Feb 10th should be safe without you testing it...yes...no?

Re: Are clothes allowed?

dead serious. Their definition of children's item leaves very little room for interpretation. There is nothing expempt at this point. If it is for a child 12 or younger, regardless of what it is, it is required to be tested.

*********

NO!!!!!!!!!!!!!!!!!!!!!!!!

Fabric and notions to NOT have to be tested by the seller, as they are not intended for children.

Fabric and notions will be no more or less safe before Feb. 10th than after.

Thus the testing burdon falls on the final seller - not the fabric store.

You must test your finished product. Component testing is not allowed.

Well, that is not entirely true. From Feb 10th to Aug 16th certificates of certification from fabric and notion manufaturers will serve as proof enough for you to issue your own certificate of compliance on your finished item.

Once Aug 16th rolls around testing must be done by an accredited 3rd party testing facility (of which the USA has only 5) the CPSC will no longer allow the certs from materials manufacturers as proof that the item does not contain lead. You must test YOUR finished item. One item from each batch must be tested. If you make a pair of pants and a shirt from the same fabric off of the same bolt, both the pants and the shirt must be tested. Also you must test each component on the garment. So even the most simple pants you would test fabric, thread, elastic. If you had zipper and snaps they need to be tested too, add a pocket in a co-ordinating fabric, that pocket needs also to be tested.

you don't have to tell us how asinine it is. We already know and we are working diligently to make sure that by Aug 16th things change.

Even if the fabric and notions have been tested, the seller must re-test.

the law states EVERYTHING for a child 12 or younger. It is what the law doesn't say that is the problem. Not what it does say.

Re: Are clothes allowed?

the law states ALL children's items must be tested

Here is the CPSC definition of Children's item. Trust me we have looked for ways out, there are none.
___________________________________________________

What is the definition of a children's product and how will the age cutoffs be determined?

A “children’s product” means a consumer product designed or intended primarily for children 12 years of age or younger. In determining whether a consumer product is primarily intended for a child 12 years of age or younger, the following factors will be considered:

* A statement by the manufacturer about the intended use of the product, including a label on the product if such statement is reasonable.
* Whether the product is represented in its packaging, display, promotion or advertising as appropriate for use by children 12 years of age or younger.
* Whether the product is commonly recognized by consumers as being intended for use by a child 12 years of age or younger.
* The Age Determination Guidelines issued by the Commission staff in September 2002, and any successor to such guidelines.

And even if they didn't have to be tested for lead, they still need to be tested for Phthalates.

Re: Are clothes allowed?

This is without a doubt the biggest crock of....I've evr heards in my life. I see the U.S. Government paying down the National Debt in the Fines of the American People when most of this problem according to the media originated in China...to whom we are in so much debt right now we can't stop trading with them....
