Are Items in my Shop OK?

I make wipes cases. I have been trying to understand which items are ok and which will need to be labeled. I understand that it effects childrens items, but are my cases childrens items? I mean, I know the wipes are used on babys but the cases themselves are actually used by the parents so I am confused. Do I need to label my items?

I'm not sure any of us is qualified to say whether yours is a children's product or not.

Here is my blog post on the CPSC definition of a children's product. You'll have to determine for yourself based on this definition if your product is included. :

In terms of other labeling requirements, you may want to check the FTC website. There are other labeling requirements for various textiles that have been in place long before CPSIA.

Thanks for the informative blog post buggalove. I notice that it says "used by children under 12" I guess thats where I get confused cause the parents are doing the "using" but the cases house products (the wipes) that are "used on" children under 12. I just dont want to do anything that breaks the law and especially dont want to harm anyone with my products. So I am just trying to decide whether to pull my items and move on to something else or not...

I understand the dilemma. It's very hard :( There are so many "parent" products that fall under this law. It is my opinion (just an OPINION), that they are a children's product, and here's why:

1) There are lots of products covered under CPSIA that are used by the parent and on children.

2) Anything in a diaper bag (or on a changing table) is typically free reign for kids. My 2 year old play with wipes and we give them the case to hold to "distract" them during a change when we're out and about. Many parents do. So to me, in the SPIRIT of the law, they are.


But don't take my opinion for gospel. There will be just as many other people telling you they're not children's products. Just another grey area in CPSIA.
