I still don't understand why CPSC doesn't just issue whatever exemptions they feel are necessary and let the courts and "public service" groups fight it out. That way they're no longer the bad guy....

really. if he was selling something kids are going to be sucking on and sleeping with, i'd understand. show me the actual risks of lead absorption riding a motorcycle.

it's just a perfect example of how far reaching this law is and the unintended, absurd consequences of not fully considering the repercussions of rushing a bill thru congress.

ruth... the CPSC has a duty to us as well as consumers to make sure that they aren't overstepping the law so much that it allows for different interpretations that leave us wide open to lawsuits.

what's the point of the law, if everything is exempted?

They tried with the phthalates retroactivity and a federal court in New York (I think the SDNY) ruled against them.

Seriously, this is the most absurd product to fall under CPSIA. As a pediatric ICU nurse, I saw dozens of ATV accidents each summer because kids didn't wear a helmet. Kids died and were permanently brain damaged from reckless ATV use. On the flip side, on my 5 years, I never once saw a kid in the ICU because he/she licked or chewed on an ATV!!! Seems like if they are going to want to focus on safety and ban an item, they have their priorities and reasons a little confused.
