I just read that there has been a stay voted on the new CPSIA and that it will be delayed for one year.

from my understanding it is for the testing. you have to make sure your products don't go above the required limits, but how you figure that out is up to you until next feb 10th.

This 1 year stay is misleading!

We are still expected to be knowledgeable and responsible for each piece of material that we use in our crafts that we sell or give away.

If someone complains to our city/state Attorney General they can still fine us $100,000 and send us to prison for selling something that may have to much lead or phthalates.

So how is that a STAY if we still have to OBEY the Federal Law that took effect as of Feb. 10, 2009.

The only different I see is that we have a 1 year reprieve for lab testing where they melt everything and also labeling our crafts to show that they are compliant.

I still haven't figured out how I am suppose to put permanent labels on my jewelry.

We need to keep fighting this stupid CPSIA LAW!!!!!

We need to get them to REPEAL the CPSIA LAW and enforce the older laws already on the books.

Or make some common sense and reasonable AMENDMENTS to this law that will not put undue hardships on smaller and micro business.

And to keep the large self-serving corporations from taking part and helping to write laws that work in their own interest....

The large corporations can afford to follow the strict rules written by CONGRESS and THEMSELVES.

Well said artisan! We removed our children tags from our stuff that could be toys in this shop and took every
single baby quilt out of our sisterthreads shop. The wording says they will not even attempt to find out if your levels are good, but that is only for lead. Pthalates are not covered under that stay. So, until it is clearly stated that things are a-ok, we just pulled everything. Ugh!

Someone please correct me if I'm wrong, but it is my understanding that it is a stay of testing and prosecution. I believe I read at the CPSA website that the general idea is know your materials, know they're safe, but they won't make you test, and they're not going to send you to jail or fine you if your items exceed the limits. Especially if someone reports that your items "may" exceed the limits, since they have no way of knowing whether you've tested or not (since manufacturers aren't required to provide certificates to consumers).

Am I wrong?

I think the stay is a great thing. This law will be amended in a big way. I'm sure of it.

The CPSC may not hunt people down and prosecute offenders but ruling states that crafters and shop owners are still responsible if anything they sell or give away has to much lead or phylates.

Besides the CPSIA has given all the different state Attorney Generals the power to prosecute anyone breaking the law.

I worry that some Attorney Generals might try to prosecute people regardless of the stay, so they can make a name for themselves, or use this law as a way to get re-elected.

artisansGifts is correct, the different State Attorney Generals will have the power to prosecute under this law and are not affected by the CPSC's decision not to prosecute. If you cannot prove your items are in compliance then IMO don't list them unless you can afford to hire an attorney to represent you in court.

In the midst of a flailing (at best) economy, I hope the resources (financial and otherwise) of the Attorneys General are spent in ways better than attempting to prosecute people who are creating with naturally lead- and phathalate-free products. I don't know how wasting the resources of a state by attempting to fine or otherwise prosecute small business producing safe products would benefit the Attorney General of any state. At this point, especially with the state, it would seem as though the burden to prove that items are *not* safe would rest solely with the prosecutor.

The etsy Storque article is informative and well-written, and contains this, taken directly from the stay:

"The Commission trusts that State Attorneys General will respect the Commission's judgment that it is necessary to stay certain testing and certification requirements and will focus their own enforcement efforts on other provisions of the law."

An AG who went after a small-time crafter using safe materials (the stay also includes a list of known-to-be-safe materials) to make crafts out of her home? What purpose would that serve, especially in the midst of a horrific economy? It's going against the CPSC's directive *and* it just seems silly.
