Someone has got to realize the craziness of this law...right? We are NOT the only smart ones around here to see it is insane. I vote for ppl who are smarter than I am to run my state and country ... Somebody will have to listen for that reason. Right? Lets hope so!

Ya know, a law is only as "good" as the enforcement. I suspect there is going to be such huge resistance to this law that it will go the way of Prohibition--repealed. Prohibition didn't work because most people ended up breaking the law.

Seriously, folks, do you really think the government is going to have the resources to go after all the people who are going to continue to sell their totally harmless products without having all the separate harmless components tested? How can you poor folks possibly afford it?

I don't sell children's things. I've read about 90% of this thread and it has been very entertaining and enlightening. I swear to God, if I did sell children's items, I'd just keep selling my untested work and let them haul me off in handcuffs. What are the chances of that anyway?

Thanks, everyone for making the rest of us aware of your plight. Your pricey items are hilarious. I love it! I'm going to look into passing them along to the consumer advocates of our local television and newspaper. Sounds like a great story to me!

The government may not have the resources to take us all down so to speak-not to mention it would look PRETTY bad to lock up some mommies and daddies for selling handmade items BUT the fact is they are taking away our rights and so many people don't realize how this will affect us all. If you have a child, grandchild, nieces or nephews, friends with children-at some point you're going to purchase something for them. Choices will be limited to the big companies only and granted they can surely afford this testing-but surely they'll pass some of the cost on to the consumers, all of us. The law needs reworked, the intentions, be it good, weren't targeted with practicality in mind. Finding goods made in the USA is next to impossible as is, this will just make it more difficult. And if I do recall, the heart of the need for this law came primarily from products made outside of the US.Yet, we are the ones who suffer. This is about freedom, a dream we all have when we open our stores, hard work, values. I'm fortunate, my store isn't the main income for my family. Although I'd be more than heartbroken to have to shut down, financially we'd survive. But I have to keep fighting for this because I have children. When we preach of the land of the free, I want them to believe in it and be allowed to dream as well.

I agree...I don't think this law will stand as it is. People will not follow is. But the thing is, people don't want to be forced to break the law, when they're really doing nothing wrong to start with.

My youngest dd is 9 months old, and I'm finding so much cool stuff I want to get for her. I'm hoping it will all still be around in the months and years to come, because I can't afford to get everything I want for the next 10 years right now!

True, the CPSC doesn't have the manpower and resources to enforce this right now to its full extent. However, the state attorney generals can also enforce it. I don't believe that many will, but just one has to have a bad day, and maybe a little pressure from a special interest group or two, and then you could have crack downs.

We'll probably be OK, but if we are selling illegally, we are open for prosecution forever in the future, any time, any place, any one. We shouldn't have to live and work to provide for our families and all of the businesses that depend on our money trickling down to them, like this. We should not be labeled as criminals and our products labeled "Banned Hazardous Substances" when they are safe and usually made with more attention to safety and detail than the mass-produced items.

Don't think for a minute that items from China are all of a sudden going to be miraculously lead free or non-toxic just because they now print off a Conformity Certificate. Their products were already supposed to be clean, but the US wasn't enforcing the regulations already in place.

Clothing does not have to be tested for phathlates, only for lead. Only toys, and items for children 3 and under that are intended for sleep, feeding, teething, etc.

Someone has probably already said this, but resellers of items don't need to do the testing. Somehow it is between the manufacturer and the reseller, and/or the manufacturer and the importer to sort that out.

So a toy made from the exact same materials as a dress would have to be tested for phthalates, but the dress won't need to be tested?

Are you referring to a reseller as in a thrift store/a seller of used articles? If you are they are tentatively exempt from testing sorta kinda, they are to use their best judgement (whatever that means) but if they sell something that is over the limit and they didn't test, then they can be prosecuted. Go figure.

I don't remember who or where this link was originally posted, but this is from the cpsc website:

"The new safety law does not require resellers to test children’s products in inventory for compliance with the lead limit before they are sold. However, resellers cannot sell children’s products that exceed the lead limit and therefore should avoid products that are likely to have lead content, unless they have testing or other information to indicate the products being sold have less than the new limit."

So it sounds like it doesn't really fall on the store owner to do it, but that they somehow need to get documentation from whomever they are getting their items from. I think it is tricky here because the store owners are also the manufacturers.
