Can a seller refuse to sell certain items using vouchers?

Doesn't that seem unfair? I mean, it's still an item in their shop, and we paid for the voucher , why can't we buy those items? /confused. I don't think the person really knows "how to work" Heartsy lol Maybe she should just take those items down while the feature is active to cut down on the confusion and to obey's Heartsy TOS. *shrugs*



''Your coupon is good for everything in our shop EXCEPT our *********. I cannot discount them! Thank you for your understanding.'''

If you cannot afford to discount something, don't have it in the shop! OR apply to Heartsy in the first place.That's the whole idea behind Heartsy, right? The "discount" feature of it? LOL

I'll give you my.02 for what it's worth- I think as long as it is made clear at the time of purchase (which I think sellers usually put in their shop announcement while the Heartsy deal is going on), that a seller has a right to exclude certain items. Other comparable sites (Groupon, Buy with me,restaurant.com, etc) frequently have restrictions on their certificates and I guess I don't see this as anything different than that. That being said, any restrictions should be limited to a couple of items or a specific group of items and shouldn't comprise a significant amoutn of the shop.

I guess the bottom line is that as a seller I feel that I should be able to dictate how the certificate can be applied and as a buyer I feel that I'm getting a great deal and as long as I know any restrictions or limitations up front, it's hard to quibble with them. But that's just my .02.

But Heartsy isn't groupon, and etsy isn't large chains that are legally allowed to give those conditions. Kwim? Heartsy has it's own rules to follow for sellers when first applying.

I contacted Heartsy earlier about it, and they just got back to me, and said it's not allowed, and that I was correct, the voucher should be used in ANYTHING in the shop. That is the pretenses they joined up with Heartsy with, and they have to abide by it. So more or less they may tell her to remove those items before she's live.

but in a sense arent heartsy buyers literally buying the item full price even though the deal is like 10$ for 50$ worth (as a example)?

If Heartsy has those rules for sellers, then that's fine. I will say that I don't recall ever having any rules or sellers agreement provided to me when my deal ran. They really didn't tell me anything once we were through the negotiations - not that I really was looking for them to, but perhaps they should if they aren't already otherwise sellers may feel that they can put some restrictions on the items. And I'm not trying to advocate that sellers should have the ability to restrict deals- it doesn't really apply to me as a seller because I wouldn't do that and as a buyer if that was the case and those were the only items i was interested in I just wouldn't buy the deal.

gee, you are correct, they are not spose to exclude stuff. the seller should have deactivated the items for the heartsy time period if they were not going to allow them to be purchased.

i can understand that some items in some shops cant be discounted for whatever reason because then they will start losing profit or come equal to what they spent making it or what they bought it for. but if a buyer (even on a deal) is spending full price for it then whats the problem? youd still be earning the same amount even without the deal running.

Seeing that Heartsy is quite new. I don't think there's any real "on paper" set of rules for sellers to follow yet, but eventually they will be.
But as of right now, even if they don't set rules, it's their site and they decide who and what to list, so they can dislike something and request to change it if they see fit. There's also rules on sellers trying to avoid using the vouchers towards shipping, and people marking up prices just before and while their shop is live, etc..

Just a thought, but if Heartsy rules state that the seller has to apply the voucher to everything then that is pretty much the deal - to not do so is a violation and is therefore wrong. The seller should de-activate items he/she does not wish to apply to the voucher. Very plain and simple to me. As for the question of "isn't the buyer paying full price with a Heartsy voucher?" No, she's not. If the deal on Heartsy is $15 for $50 worth of merchandise, then the buyer is paying $15 for $50 worth of merchandise. Plain and simple...the seller LOSES the $35 for the joy of being on Heartsy and getting the publicity and exposure otherwise known as the "cost of doing business" if you want to get noticed:-) The buyer is absolutely NOT paying full-price in this case and the seller is NOT receiving full-price.
