stealing is not cool....

Ok so someone this past week stole my whole shop name and product on facebook...it has seriously made me cry. I am not one for revenge - so maybe this girl could use some education (that always works out better anyway)

Sure maybe she liked my stuff and that's fine and all but don't take my shop name AND make wreaths AND use my pictures and say they are yours.

So can everyone please e-mail :

And let her know that stealing is not cool. And that she can come join etsy with a NEW name and we would love to have her here.

That stinks, I'm so sorry that happened :( Did you report it to Etsy? Can or did they do anything about it? I hope it gets resolved and you never have to deal with this kind of thing again.

p.s. your shop is SO adorable, I just favorited it :)

I don't know what else to say, it's infuriating, but what else can you do, your idea is great, 'kill' with kindness; it may hopefully help that person realize, touch the heart of that person and make them quit that... so sad!!!

Unbelievable! You definitely have been ripped off and how uncool is that!!! Your shop and wreaths are way cuter!!!!!!! I am sooo sorry this happened! I do will send her an email with some thoughts.

Hi Natalie! I am so sorry this happened! It's a horrible thing but at least you know that you are selling a great product - so great someone had to steal it! I would suggest adding a watermark or a custom listing template (or both) this way someone can not steal your photos!

Some people add in their policy or item listings that they are the first 100% original shop and not to be fooled by fakes or copiers! You could also urge others to report any replication they see of your product in other stores.

I could make you a custom watermark for free if you'd like! I think this would be an easy way to help! Let me know if you're interested!

As a fellow yarn wreath seller (Holla!) this is so very frustrating.

Your wreaths are beautiful and for her to have copied your design (super frustrating at a baseline), THEN to have stolen your photos, and your name -- that is unbelievable!

I tried to find her on Facbeook - is she there, too?

I just busted a copy cat of my own, so I feel your pain! Please do keep us posted.

Once you call someone out by name, email, Facebook, etc, the Etsy admin team will probably close the thread to protect mud slinging. I agree what this person did is wrong but when you give others their name that's against Etsy's TOS (terms of service). If you read the TOS it will tell you the channels to go through on Etsy. Good luck to you :)

THANKS @mesweet thats true about the e-mail - hope it wasn't seen as a bad thing but I thought HEY if we can get her to sell it in a GOOD way maybe it would fix the problem for good for everyone. Eeek hope etsy doesn't see that as mudslinging....that would be bad. That's not what i was trying to do!

I use Cosplay Day Out as the name for events I run, but also for sales, and have it registered as a DBA. A couple of other local people thought it was cute and started using it for events. I politely sent them letters explaining that trying to emulate me rather than be individual would not only hurt my business ventures, but theirs as well, because it would cause confusion. And that, furthermore, it could cause a hassle come tax time if someone did the research and saw that there were other events under the name that I did not file about, which could cause me to get audited, and that they were welcome to keep using the name if they wanted to pay my taxes. haha. Every time it worked and they stepped back and made changes. I am saving to TM so that it will be easier to avoid in the future, and so that I have a solid legal standing, but for now being nice and asking has been effective. Maybe if you went this route, and explained how her trying to be you will hurt her business, maybe she will see the light.

You know, we all put so much thought in what our name means and how it relates to our artwork and it is so disheartening to have it stolen!

My Mom always said to me you know hon, when you put your work out there people may copy it because I use my original designs. And I said Mom, as much work as I put in what I do, if they want to also put in all those hours, more power to them!

I also, had a friend that painted landscapes and when she was at some Art Shows she said some people would actually take pictures so they could duplicate it. Not right, but we do live in a world where people like the person who in effect stole your business identity... exists!

This link should help you.

Under registering a trademark it says,
"You can establish rights in a mark based on legitimate use of the mark."

So, I think you can sue her. If you were using the name first, and she came and stole it, I'd write some type of cease & desist letter to her.

My name is registered as a DBA as well. You should look into that too. You have to pay for it, but it's worth it, especially in situations such as these.
