Help please!

I sell a bracelet called "lucky elephant bracelet" because to me, elephants are known to be a symbol of luck. Someone's shop name is "The Lucky Elephant" and she e-mailed me telling me that she trademarked that name and that I need to change the name of my bracelets. I thought "lucky elephant" is common...do I really need to change the name of my bracelets? Her and I both use the same elephants but so do MANY others here on etsy. We all order them from the same jewelry website. What do I do?

I could not find any such trademark listed on the US patent and trademark website. Ask her for the serial number of trademark and link to its location on that site.

If I type "lucky elephant" into the search bar, 739 items come up with the same name. Is she really e-mailing all of us telling us the change the name? Seems ridiculous

There are over 200 items that come up in a search for 'lucky elephant bracelet'. I'd ignore the request unless they can actually PROVE that the phrase is trademarked.

Agreed, I think I'll let it be and hope she doesn't message me again...

To file a trademark is $300+ so unless she is really successful it isn't very likely that she has filed the actual paperwork... I agree ask her to provide documentation
