Copyright question

I noticed that some sellers are selling paintings to match kids bedroom sets that are sold in large stores, such as Babies r Us, etc. Is that allowed? I have no intention of causing a problem-I'm just wondering out of curiosity. I sell art for kids, but I come up with my own ideas.

Re: Copyright question

Copyright and trademark law is really complicated. I don't know how much something has to be changed before it can be considered different enough to be it's own. Also, selling things that stem from a copyrighted or trademarked item is really sketch because you are profiting from it. I wouldn't do it, just to keep from having to research it!

I have no intention of doing this, I was just wondering why others are and if it is allowed.

Re: Copyright question

If you mean 'alowed' by Etsy, then no. Selling work that infringes on copyright is not allowed by Etsy. But, they don't screen each and every listing. And many people don't read terms and conditions of selling on Etsy before they start listing items, or they don't understand that what they sell infringes on copyright.

If you're asking if it's legal, the answer is 'it depends'. As Amy just said, it can depend on how different the new work is from the original.

People will list what they think will sell. If someone thinks Mickey Mouse iPhone cases will sell, they'll probably list them here without thinking about the fact that they're using copyrighted imagery.... until Disney sues them.
