Hi Everyone

I have a big problem , my items was reported to etsy without reason I mean seller which reported my listings don't want tell me what's problem did not respond to any email which I sent, my products did not have a logo, products was different with shape, description and photo, I contacted couple of time with seller which reported me , but nothing changed, no response, I listing again products with new pictures new description etc., but after few days seller reported me again, and again , and again every time for different title,pictures, description etc..

What I can do because seller maskeraid definitely persecution me and trying remove every product which I listing, here is any help or I need go to lawyer ?

When etsy removes the listing they send you the information of the owner. If your item resembles the property of someone else you can't use it without permission. If you keep reposting the item etsy will shut you down and the owner of the image/design can sue you in court.

I had someone who kept trying to have me take an item down that was similar to theirs but mine was unique enough that it wasn’t a copy of theirs , they didn’t  have a patent, it wasn’t exactly like mine Etsy decided they had no claim against me and my item has been up on Etsy ever since

Have you communicated with Etsy to explain how yours is different?

Were you listing face masks that look anything like the masks listed on the other site? (https://www.etsy.com/shop/MaskeraidUK) Or are you just selling the sleep masks which I see on your site? If the face masks, I can see where there might be an issue. If you are selling the sleep masks only, there may be a personal/jealousy issue going on.

Thank you SunCatching I Understand but my product is different, we both sale (listing) face masks, but her is made from two layers, my is made from 3 , her is usable only on one side my is reversible, her doesn't have a filter inside my have filter, her masks have a different shape and size also she used different type of elastic etc. I know copy of someone product is illegal but for example ,if someone produced a chair then no one can make a chair?

I think competitors are ok and world with competitors is better,  because competitors make different products and very often better

I agree with everyone I would tell this to Etsy! I am also interested in your items! I will have a look! Some people can be ruthless when it comes to competition...

Hello,

Try talking to Etsy first. Let them know what is happening and that the seller who reported you will not respond. Maybe Etsy can help you understand the problem. If you have done nothing wrong and still nothing happens to fix the situation contact a lawyer.
